Injured Workers Settle Disability Discrimination Suit For $6.2 Million

Workers, who had been hurt on the job and tried to return to work, have settled a class action disability discrimination suit for $6.2 million. The workers sued Sears after they were hurt on the job, tried to return to work but Sears refused to provide them a reasonable accomodation for their disability, the suit claimed. As a result, when their leave time expired, the workers were fired.

The federal Americans With Disabilities Act and the Kentucky Civil Rights Act both require employers to reasonably accomodate an employee's disability, provided the employee can do their job.
