Comair Whistleblower Wins Suit - Kentucky Whistleblower Lawyer

A Comair pilot has won his whistleblower suit, being reinstated to his job and awarded $150,000 in damages along with having his attorney's fees paid. Comair pilot Shane Sitts was fired after he refused to fly an airplane over safety concerns.  A federal Department of Labor judge ruled that Sitts was entitled to be reinstated to his job, to recover $125,000 in back pay, $25,000 in other damages and to have his attorney's fees paid.

Whistleblower Retaliation Suit Filed for Bank CFO

A whistleblower retaliation lawsuit on behalf of the former Chief Financial Officer (CFO) of Tennessee Commerce Bancorp has been filed on his behalf by the federal Department of Labor.  The suit claims that the former CFO, George Fort, was fired two years ago after he raised concerns of possible accounting rules violations. Fort claims that he raised questions about internal controls, possible falsification of reports and regarding a large sale of stock by the bank's CEO shortly before shareholders were informed that three of the bank's Board of Directors were resigning in protest over large executive pay raises and bonuses. The suit seeks $1.5 million in back pay and benefits and Fort's reinstatement of his old job.

Whistleblower Suits Rampant In Pharmaceutical Industry

Whistleblower suits this year alone have produced payments by pharmaceutical companies for fraudulent practices of more than $4.2 billion.  The suits have been filed under the federal False Claims Act, which allows the whistleblower to recover 15-25% of the money paid by the company.  This year has seen the following settlements in whistleblower cases:

  • $1.4 billion against Eli Lilly for fraudulently and deceptively promoting unapproved uses of Zyprexa, an anti-psychotic drug
  • $2.3 billion against Pfizer for illegally promoting use of several drugs including Bextra, Geodon, Zyvox and Lyrica
  • $520 million against AstraZeneca for illegally marketing its anti-psychotic drug, Seroquel


More than 1,000 whistleblower cases are backlogged at the Department of Justice including 200 against pharmaceutical companies.

Whistleblower To Receive $4.5 Million In Government Fraud Case

A whistleblower who blew the whistle on government contract fraud will receive $4.5 million as part of a settlement between the government and MPC Products Corp., a manufacturer and supplier of fighter jets, helicopters and other military systems.  The whistleblower, Joe Caputo, reported that he was ordered to falsify cost and price justifications so MPC could increase its profit margins on government contracts.  MPC will pay some $25 million as part of the settlement.

Police Whistleblower Files Suit Over Reassignment - Whistleblower Lawyer

A police whistleblower who reported mishandling of evidence and other illegal activity in a strike force unit has filed a whistleblower suit claiming that he was retaliatated against.  Sgt. Kelly O'Rourke, a decorated police officer, claims that he was retaliated against a few weeks after reporting to supervisors mishandling of evidence and other failures to follow proper procedures in his strike force unit.  The FBI has an ongoing investigation of some of the strike force members.

Nursing Whistleblower Awarded $450,000 - Kentucky Whistleblower Lawyer

A nursing student whistleblower who reported inadequate clinical training and was kicked out of school has been awarded $450,000 for her ordeal.  Sara Castle, a nursing student at Appalachian Technical College, reported to the college's administration that she and other nursing students were not getting the required 740 hours of clinical training.  She claimed she was dismissed from the college for this whistleblower report. 

Castle said her aim was to protect the public and make sure that nursing students got all their clinical training.
