Age discrimination in employment is against federal and Kentucky law.  A class action lawsuit by coal miners against Massey Energy for age discrimination was settled for $8.75 million.

Age Discrimination Suit by Coal Miners Against Massey Energy Settles for $8.75 Million

An age discrimination suit by a group of coal miners against Massey Energy has been settled for $8.75 million.  229 miners are covered by the settlement and will receive from $19,000 to $38,000.  Massey has also been ordered to rehire 82 miners that are union members.
