Claiming They Were Misclassified Managers Sue for Overtime

Misclassification of employees as exempt from overtime is one of the most common violations of federal and Kentucky state overtime wage laws. The job title of manager does not mean that an employee is exempt from overtime pay requirements.

Store managers for Lush Cosmetics have filed a class action lawsuit in Florida for overtime compensation claiming that they were misclassified as exempt from overtime. Their suit claims that, while they had the job title of manager, they exercise practically no managerial authority and their real duties were actually that of a sales clerk or a customer service representative.
