Overbilling the federal government for heart pacemakers and defibrillators has led to a $9.25 million settlement in a whistleblower case against Boston Scientific Corporation. The whistleblower, Robert A. Fry, a former sales rep for the company reported that the company reneged on warranties to the Department of Veterans Affairs and overcharged hospitals for pacemakers, who then in turn overcharged Medicare. Mr. Fry will receive approximately $2.3 million of the settlement.

The federal False Claims Act allows whistleblowers to file suit against companies or contractors that have overcharged and/or defrauded the federal government. The whistleblower is entitled to a percentage of the money recovered from the wrongdoing company, usually 15 – 25%.
