A class action lawsuit for unpaid wages and overtime against Darden Restaurants continues to receive additional claimants.  Darden Restaurants is one of the country's largest restaurant companies operating over 2000 restaurants including Olive Garden, Red Lobster, LongHorn Steakhouse, Capital Grille, Bahamas Breeze and Seasons 52 restaurants.  The suit claims that the company failed to pay minimum wages, required waiters and waitresses to work off the clock, and failed to pay overtime wages.  

The suit is pending in federal district court in Miami and is titled Mathis v. Darden Restaurants.

This case appears to raise some typical issues for restaurant workers. For instance, waiters and waitresses are typically subject to the tip credit but often do many hours of work that is not tipped work. Obviously, doing setup work off the clock is time that has to be paid for.
