The New York Times editorial board champions passage of the age discrimination bill recently introduced in Congress, "Preventing Age Discrimination." The Times correctly summarizes the merits of the bill as follows:
Congress made clear four decades ago that it wants to protect older workers from discrimination, but the Supreme Court has tried to interfere with that effort. It is up to Congress to put the teeth back into the law.- 31 - 40
Protecting against age discrimination in employment is the aim of a bill introduced recently by Senators Patrick Leahy of Vermont, Tom Harkin of Iowa and Congressman George MIller of California. The bill seeks to reverse a decision by the Supreme Court, Gross v FBL Services, that seriously eroded protections against age discrimination. A class action lawsuit for overtime pay against Zumiez, a apparel manufacturer, has been settled for $1.3 million. The suit clailmed that the employer failed to pay employees their overtime when due and denied them breaks.

Age discrimination in the workplace will be the topic of a public hearing to be held by the Equal Employment Opportunity Commission (EEOC) on Wednesday, July 15, 2009. The EEOC hopes to draw additional attention to the growing problem of age bias in the workplace. Age discrimination complaints filed with the EEOC have risen from 15,191 in 1998 to 24,582 in 2008, a record.

Support for the Senate's passage of the Paycheck Fairness Act is urged by a guest column in the St. Louis Post-Dispatch, "Equal Pay Is Not Only About Fairness -- It's About Survival." - 37 - 40
The Paycheck Fairness Act will promote fairness and require employers to justify wage disparities by skill and experience not gender. It will prohibit employers from retaliating against employees that discuss pay issues. It will also allow victims of unlawful wage discrimination to recover compensatory and punitive damages. The Equal Employment Opportunity Commission (EEOC) voted last week to adopt new regulations implementing the 2008 amendments to the Americans With Disabilities Act (ADA). See EEOC press release here. A bill - the Healthy Families Act - requiring up to seven paid sick days annually for an employee has been introduced in Congress reports the New York Times, "Bill Would Guarantee Up To 7 Paid Sick Days." The bill would guarantee employees one paid hour off for each 30 hours worked, enabling them to earn up to seven paid sick days a year. They would be entitled to claim their days when they or a child, a parent, a spouse or someone else close to them became ill. - 40 - 40
