The Missouri Supreme Court has upheld a citizen's constitutional right to trial by jury in striking down a law that limited the damages that a person injured badly by medical negligence and malpractice could recover as pain and suffering damages.  The law was enacted in 2005 as part of an effort to increase insurance company profits and limit accountability of persons and institutions that injure others.  The Court ruled that the law "infringes on the jury's constitutionally protected purpose of determining the amount of damages sustained by an injured party."
