A Medicare fraud whistleblower case against CR Bard, a medical device maker, has been settled for $48.26 million.  The suit claimed that Bard defrauded Medicare by paying kick-backs to doctors and hospitals who prescribed its brachytherapy, a radiation treatment.  The whistleblower, Julie Darity, a former contracts administrator for Bard, will receive over $10 million as part of the settlement.

This whistleblower case was brought under the federal False Claims Act.  The False Claims Act allows whistleblowers to bring suit against companies that have defrauded the federal government and, if successful, retain 15-25% of the money recovered.
