Requiring employees to work off the clock or through their required breaks violates both the federal Fair Labor Standards Act and Kentucky wage and hour law.

A class action lawsuit brought on behalf of Wal-Mart employees in Massachusetts to collect their unpaid wages has been settled for $40 million. This lawsuit, like other similar lawsuits filed around the country, claimed that Wal-Mart unlawfully required employees to work off the clock and/or through their required breaks.  Settlements of other suits have been previously reported.
