A class action under RICO for depressed or reduced wages caused by an employer's systematic hiring of undocumented workers was approved by the Eleventh Circuit in Williams v. Mohawk Industries, Inc., No. 08-13446 (11th Cir. May 28, 2009).

The employees, who are a class of hourly workers, claimed that Mohawk and various temporary employment agencies formed a RICO enterprise to hire illegal aliens and depress wages.  The court reversed a district court's ruling and approved the lawsuit as a class action.
