A suit by retail branch and call center employees of Bank of America for overtime pay as advanced toward trial. A federal judge denied the banks attempt to have the case dismissed. The suit claims three common violations of overtime pay requirements:

(1)  the employees were awarded "comp time" instead of being paid at an overtime rate;
(2) the employees were told not to record on their time records that they had worked more than 40 hours work week;
(3) in some instances where employees recorded more than 40 hours of work their time records were changed.
