The Kentucky Bar Association violated the free speech rights of attorney John M. Berry, Jr. by threatening him with discipline if he further criticized publicly a legislative ethics commission ruled the federal Sixth Circuit Court of Appeals today in Berry v Schmitt, No 11-5456/5515 (July 27, 2012). Berry had released a letter criticizing the ethics commission's handling of an investigation pertaining to Senate President David Williams.
