Misclassification of an employee as exempt from overtime is one of the most common violations of federal and Kentucky state overtime laws.  An example of this type of case is found in the recent suit filed by an adminstrative assistant at the Blackstone Group, a private equity group.  The suit claims that she was wrongly classified as exempt from overtime while being labeled as the "lead administrative assistant."  It seeks certification as a class action on behalf of all employees misclassified as exempt from overtime.
