Employee's Commute Ruled Within Course of Employment Under Kentucky Workers Compensation Law

An employee's commute to work was ruled within the course of his employment under Kentucky workers compensation law, the Kentucky Supreme Court ruled recently in Fortney v. Airtran Airways, No 2009-SC-429-WC (June 17, 2010).  Key to the Court's decision was evidence that the employer substantially subsidized the employee's commute in order to induce him to accept employment.  The Kentucky Supreme Court's decision is discussed further by Kentucky workers compensation lawyer Robert Abell on the Kentucky Employment Law Blog: "Where Employer Induced Employee to Accept Employment by Subsidizing Employee's Commute, the Employee's Death While Commuting Was Compensable under Kentucky Workers Compensation Law."
