Health Care Workers Challenge Overtime Exemptions In Class Action

Misclassification of employees as exempt from overtime is one of the most widespread and common violations of the Fair Labor Standards Act and Kentucky overtime law.

Health care workers including registered nurses, occupational therapists and physical therapists have filed a class action lawsuit seeking overtime, claiming that they were misclassified as exempt from overtime.  The case has been filed in federal district court in New York and is styled Rindfleisch, et al. v. Gentiva Health Services, Inc, Case No. 2:10-cv-02111-JFB -ARL).
