Kentucky Counties & Cities Are Not Immune from Overtime Law

Counties and cities in Kentucky are not immune from overtime pay requirements the Kentucky Supreme Court ruled today in Madison County Fiscal Court v. Kentucky Labor Cabinet, No 2010-SC-000322-DG (August 25, 2011). As a result, the Court further ruled that the Labor Cabinet may enforce overtime pay requirements on behalf of firefighters against cities and counties.  The ruling will also allow individual employees to recover overtime owed them by cities and counties in private lawsuits brought in circuit court.
