UPS Delivery Driver Overtime Suit Settled for $12.8 Million

Misclassifing employess as independent contractors and failing to pay them overtime is a violation of the federal Fair Labor Standards Act and Kentucky wage and hour law.

A class action lawsuit for unpaid overtime by delivery drivers, who were misclassified as independent contractors, against UPS Supply Chain Solutions has been settled for $12.8 million.  The suit was filed in federal district court in northern California.
