The scope of protection afforded railroad workers by the Federal Employers' Liability Act (FELA) will be decided by the Supreme Court. The issue in the case is the degree of negligence that must be attributable to the railroad for it to be liable for a workers' injuries. The case is CSX Transportation v. McBride, No. 10-235.
