A tip pool scheme was at the heart of a $5.25 million settlement reached in a class action lawsuit by waiters, servers and bartenders at a group of New York City area restaurants owned by celebrity chef Mario Batali claiming that a portion of their tips had been wrongfully withheld. The suit, which would cover up to about 1,100 employees, claimed that an amount equivalent to 4-5% of the wine sales were deducted from the employees' tip pool each night. The settlement must be approved by a federal judge.
