Court documents unsealed by a California judge show that Johnson & Johnson did an internal review in 2011 and concluded that 40% of its ASR hip replacement devices would fail within five years.  The company recalled the devices in 2010, while pooh-poohing British reports about the device's early failure rate.  The documents were released as the first of the some 10,000 lawsuits filed by victims of the defective product is set to go to trial in Los Angeles.  About 93,000 people received the ASR devices worldwide, most in the United States.
