Shift managers for the CVS drugstore chain are seeking unpaid overtime compensation in a class action lawsuit filed under the Fair Labor Standards Act in federal court in Louisiana. The lawsuit claims that shift managers were routinely required to work more than 40 hours a week and off the clock to complete duties including compiling administrative reports, operating a cash register, ordering stock, stocking shelves, cleaning, and more.

This case presents the question of whether these shift managers have been misclassified as exempt from overtime pay requirements.  The misclassification of employees as exempt from overtime is one of the most common violations of federal and Kentucky overtime pay laws. And the point that could not be made enough: a job title that includes "manager" in it does not mean that the employee is exempt from overtime pay requirements.
