Two deputy sheriffs in Lackawanna County, Pennsylvania have filed suit seeking payment of overtime compensation they have earned.  The deputies, Michael Souryavong and Edwin Velez, claim that they regularly worked more than 40 hours per workweek and were not paid overtime. Their suit also includes a claim against their union, the Lackawanna County Deputy Sheriffs Association, for breaching its duty of fair representation with regard to a grievance they had filed regarding the overtime pay.

Under both federal and Kentucky state law employers are required to pay employees an overtime rate of 1.5 times their regular hourly rate for hours worked in a workweek greater than 40.
