The family of a bicyclist, who was struck and killed by the SUV driven by a drunk driver, has filed a wrongful death lawsuit.  Robert George was in a cross-walk when hit by the Gustavo Palmer's SUV. Palmer later pleaded guilty to driving under the influence (DUI); his blood-alcohol at the time of the accident was .093.

In Kentucky a driver is presumed intoxicated if his or her BAC is .08 or higher.
