Field technicians (field techs) for OneSource Building Technologies have filed a class action suit for overtime, claiming that they are in reality employees not independent contractors and entitled to overtime pay. Classifying employees as independent contractors is, as I've discussed before, one of the most-frequently used overtime dodges: Independent Contractor or Employee-One Way to Steal Overtime. This kind of cheating allows for a number of competitive advantages over law-abiding companies and employers including saving on overtime, saving on unemployment compensation, saving on workers compensation and saving on employee and Medicare taxes.
