A group of Kentucky coal miners have filed suit seeking payment of unpaid wages. The miners sued United Coal, Wellmore Coal and Sapphire Coal companies for wages whose payment was deferred but which, according to the suit, became payable if they were laid off. The wages are part of a "loyalty reward plan" in which 10% of the miners pay was set aside as deferred compensation to be fully paid in six years or upon a layoff or closing.

This looks like a pretty straight-forward suit for unpaid wages. Under Kentucky law "wages" are defined to include whatever compensation an employer agrees to pay an employee for their work.
