Orthopedic surgeons defrauded Medicare by billing it for surgeries actually performed by residents, a whistleblower lawsuit claims.  Former surgeon and hospital executive Robert Goldberg claims in the suit that surgeons at Chicago's Rush University Medical Center violated Medicare rules by billing the federal program for surgeries that were actually performed by residents.  The whistleblower lawsuit was filed under the federal False Claims Act.

The federal False Claims Act allows for a whistleblower to recover 15-25% of the total monies recovered from a company that has defrauded the federal government.
