A service technician has filed suit claiming that he was fired in retaliation for his complaints that he was not being paid overtime compensation. The service tech, Michael Pittell, claims that his employer, Tolt, a technology support company, required him and other technicians to work overtime without paying them for it. Pittell's lawsuit claims that overtime should have been paid him and other service techs for the following reasons:

  • he and other service techs were required to work through their lunch breaks but were required to sign time sheets stating that they had taken the breaks
     
  • they were required to be on call 24 hours a day on days they were scheduled to work their regular shift
     
  • routinely performed work before and after the official start and end of their shifts for which they were not paid

Pittell claims that he was retaliated against and fired when he tried to enforce his rights under the federal Fair Labor Standards Act.
