Claiming that they were misclassified as outside sales reps and exempt from overtime compensation requirements workers for Russell Stover candy nine employees have filed suit.  The plaintiffs claim that they spent the majority of time receiving shipments, inspecting, unpacking, stocking, cleaning, processing credits, repairing display fixtures and performing other manual labor. Outside sales reps are exempt from overtime.

Just classifying, labeling or giving someone a job description as an employee exempt from overtime does not mean that the employee is exempt from overtime.  One common violation of the federal Fair Labor Standards Act and its Kentucky state law counterpart is misclassifying employees as exempt from overtime.
