David and Linda Kubert were badly injured when Kyle Best veered into them and struck them on their motorcycle; they both lost a leg as a result. Best has testified that right before the crash to glanced at his cell phone to see who had just sent him a text message. The sender of the text, Best's girlfriend, Shannon Colonna, has testified that she may have known that Best was driving at the time she sent the text message. A judge will decide whether Colonna will remain in the suit and be subject to liability for the Kubert's injuries.
