Store managers and assistant managers at Rite Aid drugstores have settled an overtime suit for $20.9 million.  Although the store managers and assistant managers were salaried, the suit claimed that they were misclassified as exempt from overtime.  The settlement will cover approximately 9400 class members, who were employed as Rite Aid store managers or assistant managers since April 8, 2006.

Just because you have the job title that of manager or store manager doesn't mean that you are exempt from overtime pay requirements.  Likewise, just because you are paid on what is or is purported to be a salary basis doesn't mean that you are exempt from overtime pay requirements.  Both federal and Kentucky overtime law are frequently violated because an employee is misclassified as exempt from overtime.
