Present and former technical writers for medical software make Epic Systems have filed overtime suits in federal court in Wisconsin.  The suits claim that the technical writers were misclassified as exempt from overtime pay requirements, although they acknowledge that the technical writers were paid on a salary basis.  Epic recently reached a $5.4 million settlement with quality assurance workers in an overtime suit.

This case is a very common violation of the overtime pay laws.  Just because an employee is paid a salary, the employee's job must be of such a nature as to cause them to fall within one of the occupational exemptions to overtime.  While these technical writers may have been paid on a salary basis, they remain entitled to overtime if their jobs were not exempt. Just being paid a salary does not mean that overtime doesn't have to be paid.
