Technicians, maintenance workers, operators, laborers and other administrative workers all who work on or related to pipelines for Kinder Morgan Energy Company are seeking over $1 million in unpaid overtime. The issue in this case is whether the operators, technicians, maintenance workers, laborers and other administrative workers are exempt from the overtime requirements of the federal Fair Labor Standards Act.

This case represents a typical abuse and misclassification of employees as exempt from overtime pay requirements.  An employee is not exempt from overtime pay requirements just because they are paid on a so-called "salary" basis.  Being paid on a salary basis is only one factor or step in being exempt from overtime pay requirements.
