Omnicare, the giant pharmacy company, has settled another whistleblower lawsuit, this one alleging kickbacks in its 2004 acquisition of Total Pharmacy Services. The whistleblower, Maureen Niehls, claimed in a 2007 lawsuit that the acquisition price included payment to one of Total Pharmacy's owners for nursing home contracts. Omnicare settled a whistleblower case in May for $50 million involving allegations that it billed for medications never actually administered. In 2010, it settled another whistleblower suit - that one claiming that it overbilled Medicaid -- for $21 million.
