A hospice care provider has agreed to pay $25 million to settle a whistleblower suit arising from false claims it submitted to Medicare. The whistleblower, Jane Tuchalski, a former company nurse, claimed that Odyseey Healthcare, Inc. defrauded Medicare by enrolling and recertifying non-terminal patients and then continuing to bill for services not necessary or reasonable. Odysse, which is now part of Gentiva Healthcare, paid $12.6 million to settle a whistleblower suit in 2006.

The federal False Claims Act allows whistleblowers to file suit to recover monies that government contractors and suppliers have defrauded the government of. The whistleblower will keep, as a service fee, some 15-25% of monies recovered.
