Discrimination based on a disability violates both the Americans With Disabilities Act and Kentucky law.  Epilepsy can constitute a protected disability.

A police detective, William Blake, a detective in with the Baltimore County police department, suffered an epileptic seizure in 1996.  Ten years later, after zero epileptic episodes in the 10 year interim, the police department ordered him to submit to neurological and fit-for-duty tests; this violated the Americans With Disabilities Act and constituted disability discrimination, his lawsuit claimed.  A federal court jury found in his favor and its verdict included $225,000 in damages.
