Illinois has become the second state to bar employers from requiring employees and applicants to disclose their passwords to Facebook, Twitter and other social media sites. Maryland is the other state with such a law. There is no federal law. Also, the law does not apply to publicly accessible and viewable pages on a site.

While this law provides some privacy to employees and job applicants in Illinois, it does not change anything in Kentucky. The law also does not say that an employer cannot fire an employee for what he or she posts on Facebook, tweets on Twitter or otherwise posts. The ramifications of social media posting have been discussed previously: Can I be fired for what I say about my company on Facebook?
