Facing widespread violations of the Uniform Services Employment and Reemployment Act (USERRA) the Department of Justice is "cracking down on employers that discriminate against returning injured soldiers, who are having a hard time getting their old jobs back, either being demoted, or denied work altogether" reports law.com, "DOJ Cracks Down On Discrimination Against Injured Returning Soldiers." The report states that DOJ's Civil Rights Division is filing suits nationwide on an almost weekly basis.  

USERRA requires employers, under certain conditions, to return individuals back to work in their civilian jobs after military service and also protects servicemembers from discrimination in the workplace based on their military service or affiliation. More about USERRA can be learned here.
