Discharged Employee Entitled To Unused Vacation Pay - Kentucky Employment Lawyer

A discharged employee is entitled to be paid for him unused vacation pay the Massachusetts Supreme Judicial Court has ruled in Electronic Data Systems v. Attorney General, No. SJC 10260 (June 11, 2009).   The basis for the Court's ruling was that the state's wage and hour law defined earned, accrued vacation pay as "wages" and further that all earned wages must be paid at the time of discharge.
