Male Accused of Sexual Harassment May Sue For Sex Discrimination

A male employee accused of sexual harassment, stereotyped as guilty and fired may sue for sex discrimination. The Second Circuit Court of Appeals so ruled recently in Sassaman v. Gamache and reiterated the Supreme Court's observation in Price Waterhouse v. Hopkins:  "we are beyond the day when an employer could evaluate employees by assuming or insisting that they matched the stereotype associated with their group."
